Generally speaking, if your business utilizes a background music service, you should verify with them whether your subscription fees include licenses with each of the five (5) US Performing Rights Organizations (PROs). Not all background music services obtain PRO licenses that cover uses of music in businesses. Other background music services come with only some PRO licenses, while others don’t come with any PRO licenses at all. In the latter case, many background music services encourage their subscribers to obtain licenses directly with PROs on top of their background music subscriptions.

If your background music subscription does not come with licenses from all PROs, it’s important to note that your business will be in violation of US Copyright Law the moment that it plays unlicensed music. Without the proper licenses in place, your business will be at risk of incurring substantial fines and penalties that grow with each unlicensed song played.
