Under US Copyright Law, the creator (songwriter, author, composer, producer) of a song owns and controls the exclusive right of public performance to that song, and a public performance occurs when a party "transmits or otherwise communicates a performance" by means of "any device or process". Accordingly, a website, app or other digital property cannot legally stream or play music, regardless of whether it is in audio or audiovisual format, without first having secured the right of public performance.

A business must secure a license to publicly perform music in advance of music being streamed, used on a website or used within a digital application.
