Under US Copyright Law, the music creator (songwriter, composer, producer) of a song owns the exclusive right of public performance. Copyright Law specifically notes that to perform publicly is to "transmit or otherwise communicate a performance" by means of "any device or process". Accordingly, a website, app or other digital property cannot legally stream or play a song, regardless of whether it is audio or audiovisual, without receiving a license. A proper performance license must be obtained prior to the music being streamed or used.
